WorkGY — Terms of Service
1. What WorkGY is
WorkGY is a marketplace that connects customers (“Customers”) with independent service providers (“Workers”) to perform real-world tasks (“Tasks”). WorkGY is not an employer, agency, contractor, or party to the Task itself. We provide:
- A platform for posting Tasks, applying to Tasks, and inviting Workers to Tasks.
- Messaging between connected Customers and Workers, made available once the Customer pays the Connection Fee (Section 4).
- A review system.
Everything else — the actual performance of the Task and the payment for the Task itself — is between the Customer and the Worker. WorkGY does not process, hold, escrow, or guarantee the Task payment and is not a party to it (Section 4).
2. Accounts
- You must be at least 18 years old.
- You agree to provide accurate information and keep your credentials secret.
- One person, one account. We may suspend duplicate or fraudulent accounts.
- You can delete your account anytime per the Privacy Policy.
3. Worker eligibility & independent-contractor status
- Workers represent that they are legally allowed to perform the Tasks they apply to in their jurisdiction, including holding any licence, registration, or insurance the Task requires.
- Workers are independent service providers, not employees, agents, joint venturers, or representatives of WorkGY. WorkGY does not direct or control how, when, or with what tools Tasks are performed, does not set Workers’ rates (Workers set their own), does not provide tools or equipment, and does not guarantee any volume of work. Nothing in these Terms creates an employment relationship, and Workers are not entitled to employment benefits from WorkGY.
- Workers are solely responsible for their own tax, national-insurance, and statutory obligations on amounts earned from Tasks arranged through WorkGY.
- Workers pay no fees to WorkGY and receive no payments through WorkGY. Payment for the Task is arranged directly between the Worker and the Customer (Section 4).
- WorkGY may require approval before a Worker’s profile is visible. Approval can be revoked at our discretion.
3a. No background checks; assumption of risk
- WorkGY does not perform background checks, identity verification, licence checks, or vetting of any user. Customers and Workers interact at their own risk.
- Tasks happen in the real world, often in private homes. You are solely responsible for evaluating the other party, the premises, and the Task before proceeding, and for taking reasonable safety precautions.
- To the maximum extent permitted by law, you assume all risk arising from in-person interactions arranged through WorkGY.
3b. Official Partners
- WorkGY may designate a limited number of businesses as Official Partners. Designation is at WorkGY’s sole discretion: we may decline applications, limit the number of Partners (including to a single business per service category), and revoke Partner status at any time. An Official Partner may be affiliated with — including related by family to — the operator of WorkGY. Partner status is a commercial designation, not an endorsement, guarantee, or vetting of the Partner or its Workers; Section 3a (no background checks; assumption of risk) applies in full.
- Worker profiles managed by a Partner are labelled “Managed by [Partner]” in the app. For those profiles, a Partner coordinator participates on the Worker’s side of the Booking: the coordinator receives your job requests, can read and send messages in the Booking’s conversation, and may act on the Worker’s behalf — accepting invitations, proposing or responding to price offers, and proposing substitutions. - Worker substitution (same Partner, no extra fee): if a managed Worker becomes unavailable, the Partner may propose a substitute Worker from the same Partner inside the app. A substitution takes effect only if the Customer accepts it in-app — the Customer always chooses who does the work. If accepted, the existing Booking — the Connection Fee already paid, the conversation, and any agreed price record — carries over to the substitute, and no additional Connection Fee is charged. If declined, the Booking is unchanged. Reviews attach to the Worker who actually performed the Task. Preferring a Worker not managed by the same Partner is instead a cancellation of the existing Booking (Section 6 — the fee returns as in-app credit) followed by a new Booking.
- Blocking: blocking a managed Worker blocks that Worker only — the Partner’s other Workers remain available to you. Blocking a Partner coordinator blocks that Partner’s managed profiles as a whole, since every connection with them routes through the coordinator.
- Partners and their Workers remain independent service providers under Section 3. Responsibility for the performance, quality, safety, and staffing of a Task rests with the Partner and the Worker, not WorkGY.
4. Bookings, the Connection Fee & Task payment
- A Booking is created when a Customer accepts a Worker’s application, or when a Worker accepts a Customer’s direct invitation to a Task.
- To activate the Booking and be connected with the Worker, the Customer pays WorkGY a fixed Connection Fee (currently GY$1,500; Section 7), charged via our payment processor, Stripe, through the in-app PaymentSheet. WorkGY never sees card details.
- Payment for the Task itself is arranged directly between the Customer and the Worker, outside the WorkGY platform. WorkGY does not process, hold, escrow, transmit, or guarantee the Task payment, sets no Task prices, takes no commission on Task amounts, and is not a party to the payment or the Task. Any dispute over the Task payment is between the Customer and the Worker.
- The Connection Fee’s payment status shown in-app becomes authoritative only once confirmed by our payment processor.
- If a paid Booking is cancelled by either party, the Connection Fee is returned to the Customer as in-app credit (Sections 6 and 7) — not as a monetary refund, except as described in Section 6 or where required by law.
- Refunds, credits, and disputes: see Sections 6 and 7.
5. Customer conduct
- Tasks must be lawful and must not fall under Section 5a (Prohibited services).
- Customers must provide accurate Task descriptions, addresses, and budgets.
- Customers are responsible for the safety of their premises.
5a. Prohibited services
The following may not be requested, offered, or performed through WorkGY. WorkGY launches in Guyana, and “the place of performance” below means Guyana unless WorkGY later opens additional jurisdictions.
- Anything illegal in the place of performance.
- Services requiring a professional licence, certification, or registration that the Worker does not hold — for example electrical, gas, or plumbing certification work, medical or nursing care, and legal or financial advice. These regulated trades are excluded entirely at launch: WorkGY does not verify licences, so such Tasks may not be posted or performed through the platform.
- Childcare, eldercare, or care of any vulnerable person. Excluded entirely: WorkGY performs no background checks, so these Tasks may not be requested, offered, or performed through the platform.
- Sexual or adult services of any kind.
- Purchase, transport, or handling of weapons, illegal drugs, or hazardous materials.
- Tasks involving access to third-party property without that party’s consent.
- Academic fraud (essays, exams), impersonation, or identity-document work.
- Any task designed to harass, surveil, or harm a person or animal.
WorkGY may remove Tasks, cancel Bookings, and suspend accounts that breach this section, without refund or credit of the Connection Fee.
6. Disputes between users; cancellations, credits & refunds
- Try to resolve it in chat first.
- Either party may mark the Booking as disputed in the app.
- Cancellation credit: if a paid Booking is cancelled by either party, the Connection Fee is returned to the Customer as in-app credit, applied automatically toward the Customer’s next Connection Fee(s) in the same currency. In-app credit has no cash value, is non-transferable, and is not redeemable for money. To deter abuse, credit is issued for at most three (3) cancelled paid Bookings in any rolling 30-day period; further cancellations in that window receive no credit and the account is flagged for review.
- Monetary refunds of the Connection Fee are exceptional and issued at WorkGY’s sole discretion (e.g. for disputes or goodwill), except where required by applicable consumer-protection law. A monetary refund is available only for a Booking that has been marked disputed or cancelled, and may be full or partial, up to the Connection Fee actually paid for that Booking. WorkGY has no authority over — and does not mediate, refund, or guarantee — the Task payment itself, which is arranged directly between the Customer and the Worker.
- The card-network dispute (chargeback) process remains available to Customers for the Connection Fee charge as a last resort; a chargeback may result in a monetary refund rather than in-app credit.
- Official Partner substitutions are not cancellations: a Customer-accepted substitution under Section 3b continues the same paid Booking with the substitute Worker — no credit is issued, no additional Connection Fee is charged, and it does not count toward the cancellation cap above.
7. Fees
- Connection Fee: a fixed GY$1,500 per Booking, paid by the Customer (charged in Guyanese dollars) to be connected with the Worker (messaging is made available to the connected parties). It is the only fee WorkGY charges. The fee applicable to a Booking is the one shown at the time of payment.
- Workers pay nothing. WorkGY takes no percentage or commission of the Task amount, which is agreed and paid entirely between the Customer and the Worker off-platform.
- In-app credit from cancellations (Section 6) is applied automatically against future Connection Fees in the same currency, has no cash value, and expires with the account.
- Fees may change with prospective notice in-app.
- Stripe processing fees are absorbed by WorkGY from the Connection Fee unless otherwise stated.
8. User content & reviews
- “User Content” means everything you post on WorkGY: Task descriptions, photos and videos attached to Task postings, messages, reviews, and profile information.
- You retain ownership of your User Content, but you grant WorkGY a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, transcode, display, and distribute it within and in connection with operating the service, for as long as it remains on the platform. This license ends when the content is deleted, except for copies in routine backups and content already shared with other users.
- Reviews must be honest first-person accounts. No retaliatory, fake, or paid reviews.
8a. Task media (photos & videos)
- Photos and videos attached to a Task posting are visible to all signed-in users browsing tasks. Do not upload anything you want kept private.
- You may only upload media you created or have the right to use. Do not upload media that identifies other people without their consent.
- Media must depict the Task honestly. Limits apply (currently 5 photos and 2 videos of up to 60 seconds per posting) and may change.
- WorkGY may remove media, or the posting, that violates these Terms or the Community Guidelines, with or without notice.
8b. Moderation, reporting & blocking
WorkGY may (but has no general obligation to) review, screen, remove, or restrict User Content at any time, including via automated tools. We are not liable for User Content posted by others. Report violating content, profiles, or messages with the in-app Report option (available on profiles, task posts, and chat messages) or via Support. You can also block any user in-app to stop contact in both directions. Reports are reviewed by our team; accounts that break the rules may be suspended.
8c. Copyright complaints (notice & takedown)
If you believe content on WorkGY infringes your copyright, send a notice to legal@workgy.gy including: (1) identification of the work, (2) the location of the infringing material, (3) your contact details, (4) a good-faith statement that the use is unauthorized, (5) a statement under penalty of perjury that the notice is accurate and you are authorized to act, and (6) your signature. We will remove or disable access to material we reasonably believe infringing, notify the uploader, and accept counter-notices. Repeat infringers’ accounts will be terminated.
9. Acceptable use
You agree not to:
- Use WorkGY to harass, defraud, dox, or threaten anyone.
- Circumvent the platform to avoid the Connection Fee (e.g. soliciting contact details before a Booking is paid in order to bypass it).
- Reverse engineer, scrape, probe, or attack the service, or attempt to bypass its security or rate limits.
- Impersonate another person.
- Post personal data of third parties without consent.
We may suspend accounts that violate these rules.
9a. Non-discrimination (both directions)
- WorkGY does not discriminate, and does not permit discrimination, on the basis of race, colour, ethnicity, national origin, religion, sex, gender identity, sexual orientation, age, disability, or any other characteristic protected by applicable law.
- Customers may not refuse a Worker, and Workers may not refuse a Customer, on the basis of a protected characteristic. Declining for legitimate, non-discriminatory reasons (price, availability, scope, safety concerns about the specific Task) is always allowed.
- Reviews and messages containing slurs or discriminatory statements will be removed and may lead to suspension.
10. Disclaimers, limitation of liability & indemnification
10a. Disclaimers
WorkGY is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Tasks will be performed safely, competently, or at all, or that any user is who they claim to be.
10b. Limitation of liability
To the maximum extent permitted by applicable law: (a) WorkGY is not liable for the acts or omissions of Customers or Workers, the quality or safety of work performed, or any indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill; and (b) WorkGY’s total aggregate liability arising out of or relating to the service is limited to the greater of (i) the Connection Fees you paid to WorkGY in the twelve (12) months before the claim arose and (ii) one hundred US dollars (USD $100). Some jurisdictions do not allow certain exclusions or limits; where they don’t, these apply to the fullest extent permitted.
10c. Indemnification
You will indemnify and hold harmless WorkGY, its directors, officers, and employees from claims, damages, and reasonable legal costs arising from (a) your User Content, (b) your performance or receipt of a Task, (c) your breach of these Terms, or (d) your violation of law or third-party rights. WorkGY will promptly notify you of any such claim and may participate in the defense at its own expense.
11. Termination
- You can stop using WorkGY anytime.
- We can suspend or terminate access for violation of these terms, fraud, or risk to other users. Where practicable we will give notice and a reason; we may act immediately where safety, fraud, or legal exposure requires.
- Termination does not affect obligations already accrued: Connection Fees already paid are handled per Section 6, and any amounts owed between a Customer and a Worker for Tasks performed remain between them.
- Sections 8 (license, for content already shared), 10, 12, and 13 survive termination.
12. Governing law & dispute resolution
12a. Governing law
These Terms, and any dispute arising out of or relating to them or to your use of WorkGY, are governed by the laws of the Co-operative Republic of Guyana, without regard to its conflict-of-laws rules.
12b. Forum — users outside the United States
Subject to Section 12c, you agree to submit to the exclusive jurisdiction of the courts of Guyana (Georgetown).
12c. Users in the United States — arbitration & class-action waiver
If you reside in the United States: any dispute that cannot be resolved informally will be finally settled by binding individual arbitration administered by a recognized arbitration provider under its consumer rules, rather than in court, except that (a) either party may bring an individual claim in small-claims court, and (b) either party may seek injunctive relief for intellectual-property misuse. You and WorkGY each waive the right to a jury trial and to participate in a class action. You may opt out by emailing legal@workgy.gy within 30 days of first accepting these Terms.
12d. Time limit
To the extent permitted by law, claims must be brought within one (1) year of the events giving rise to them.
13. General
- Severability: if any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary, and the remainder stays in force.
- No waiver: failure to enforce a provision is not a waiver.
- Assignment: you may not assign these Terms; WorkGY may assign them in connection with a merger, acquisition, or sale of assets, with notice.
- Entire agreement: these Terms, the Privacy Policy, and the Community Guidelines are the entire agreement between you and WorkGY about the service.
14. Changes
We will notify you of material changes via the app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
